Terms and Conditions

Disclaimer: 

  1. The contents of this website, and on any and all other online platforms we use, including email, does not constitute health or medical advice and is not intended to be health or medical advice. 

  2. Neither we, nor the Counsellors you book through our website, provide a crisis service. If you are experiencing an emergency, please contact emergency services.


DEFINITIONS 

In these Terms unless the context otherwise requires:

  1. ‘authorised page’ means an online page specifying details of Events, produced or endorsed by us, which includes our website. 

  2. ‘Booking Service Provider’ means a booking service provider we may engage from time to time who provides appointment booking software.

  3. ‘Course’ means courses offered by us from time to time that relate to mental health and wellbeing.

  4. ‘Events’ means events organised by us, Workshops, and Courses. 

  5. ‘personal information’ includes all information collected by us from you (directly or indirectly), including sensitive information as defined in the Privacy Act 1988 (Cth), and includes information such as:

    1. medical records; 

    2. name, date of birth, gender; and 

    3. address and contact information;

  6. ‘prepayment’ means a payment required prior to the provisions of Services, which may vary from time to time; 

  7. ‘Counsellorss’ means the healthcare practitioner we contract and represent on our website, including qualified and affilaited counsellors; 

  8. ‘Services’ means counselling or other services provided by us and, including via Workshops and Courses; 

  9. ‘us’ ‘we’ ‘our’ means Mid North Coast Counselling ABN 98172016002

  10. ‘Workshop’ means workshops offered by us from time to time, relating to mental health and wellbeing. 

  11. ‘you’ means the client receiving the Services. 


APPLICATION 

These Terms apply when you use our website and for administration dealing with ancillary services, such as payments, and booking.

COUNSELLING SERVICES

The Counsellors have agreed to provide their Services under the applicable provisions set out in these Terms. 

All Services will be provided to you online, by video or audio chat, or a combination of both. We may nominate specific online platforms to conduct appointments. Any platforms nominated by us to conduct an appointment will be subject to the cyber-security guidelines imposed by any governmental agency and regulatory organisation applicable to health practitioners, and any that we may implement. In no way are we responsible for any security breach by such provider.

CONFIDENTIALITY

Please note, we also have a privacy policy which can be found on our website

Subject to the provisions in our Privacy Policy, all personal information collected by us:

  1. in no way will confer on us any proprietary rights over your personal information; and 

  2. will remain strictly confidential, unless:

    1. disclosure to a third party is required by law; 

    2. failure to disclose the information would place you or another person at serious, and, or imminent risk; 

    3. consent is given by you to us, 

in which case, we will notify you of such disclosure as soon as practicable, unless required by law otherwise.

FEES 

You can find the fees for the Counsellors listed on the website under ‘Bookings’. Fees may vary from time to time, at the Counsellor’s discretion. 

All fees are GST-inclusive, unless otherwise specified. 

If you have a dispute regarding a fee, you must notify us within 14 days of when the fee was debited from your account. We will review the dispute and provide you with the outcome within 14 days.

PAYMENT TERMS 

1. Counsellor Appointments

First appointments with a Counsellor require a prepayment to secure the booking. This pre-payment is non-refundable and non-transferable. If you cancel or reschedule your appointment with more than 48 hours notice, the prepayment will be credited to your account and must be used within 90 days. Any cancellations and rescheduled requests made for first appointments with less than 48 hours’ notice may not be refunded at our sole discretion.

For subsequent appointments if you cancel or reschedule your appointment with more than 48 hours notice, you will not be charged for the appointment. If you request to cancel or reschedule your appointment with less than 48 hours’ notice, you will be charged the full appointment fee. 

Subsequent appointments are required to be paid for at the end of each appointment. You authorise us to debit your nominated bank account at the end of each appointment for an amount equal to the applicable fee, and to store your payment details on our third-party payment gateway provider. 

2. Events 

Unless otherwise specified on the authorised page, all payments for Events are required to be paid in full at the time of booking.

REBATE 

At the end of each appointment, you will be provided with a receipt, which you may use to claim on your private health insurance or Medicare (if you have been referred to one of our Psychologists under a mental health care plan). Any rebate for your health fund will be subject to your personal cover.

CANCELLATION TERMS

Any cancellations or requests to vary an appointment with a Counsellor must be notified to us prior to 48 hours before your appointment. If you do not notify us of such cancellation or variation with at least 48 hours notice, we reserve the right to charge you the full fee of your appointment. Please note these fees cannot be claimed through your private health fund or Medicare. 

The above cancellation terms:

  1. also apply to Events unless otherwise stated on an authorised page; and

  2. do not apply to first appointments

Please note that while we endeavour to remind you of your appointments through an email and, or SMS reminder 24 hours prior to your appointment (if you consent to such notifications), we are not responsible for any costs you may incur due to any failure of receiving such reminder.

  • Please note we do not accept cancellations via SMS.


Conditions of Cancellation Policy

If you have been charged a cancellation fee, it must be paid prior to the provision of any further services. Cancellation fees must be paid by you personally, even if you use health care organisations that typically cover your appointment expenses (for example, Medicare or private health funds). If you fail to make payment of any outstanding monies, we may charge the amount from your account.

Late to Appointments

Unless otherwise agreed upon by you and the Counsellor, sessions are strictly fifty (60) minutes long and will not be extended, including for late arrivals. 

If you are more than ten (10) minutes late, or do not show up for your appointment, you will be liable for 100% of the appointment fee, at our sole discretion.

SAFETY 

We do not tolerate any type of abuse or harassment toward us, and or the Counsellors. Notwithstanding anything else in this Agreement, if you display any conduct towards us or the Counsellor that we reasonably consider to constitute abuse or harassment, then at our reasonable discretion, we may cancel your appointment at any time and report your behaviour and have the right to keep any payment you have made.

INDEMNITY 

You indemnify us:

  1. against all losses, claims, damages and liabilities for any breach of the Terms by you; and 

  2. for all expenses (including legal fees and expenses on a solicitor and own client basis) should we incur any in connection with the investigation of, preparation for, or defence of, any pending or threatened related claim of any action or proceeding arising from your breach of these Terms, 

unless such loss, claim or expense was caused by a negligent act or omission by us.

JURISDICTION

These Terms are governed by the law in force in New South Wales. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts which may hear appeals from those courts in respect of any proceedings in connection with this Agreement.

INTERPRETATION 

In these Terms, unless the context otherwise requires: 

  1. the singular includes the plural and vice versa;

  2. a reference to an individual or person includes a corporation, partnership, joint venture, association, authority, trust, state or government and vice versa;  

  3. headings are inserted for convenience only and do not affect the interpretation of this document;

  4. a reference in this document to any law, legislation or legislative provision includes any statutory modification, amendment or re-enactment, and any subordinate legislation or regulations issued under that legislation or legislative provision;

  5. where an expression is defined, another part of speech or grammatical form of that expression has a corresponding meaning;

  6. mentioning anything after ‘include’, ‘includes’ or ‘including’ does not limit what else might be included; and 

  7. a reference to any fee is in Australian currency.
